Let affidavit-of-service, as filed in Court, be kept on record. 2. Petitioner is granted liberty to add Principal Accountant General (A & E), West Bengal, Treasury Building, 2, Government Place (West), Kolkata – 700 001, as party respondent no. 5 in this proceeding. 3. Mr. Bajpayee, learned Advocate appearing for all the respondents along with Mr. Majumder, learned Advocate, is requested to appear on behalf of the added respondent no. 5. 4. The petitioner has served in the Department of Women and Child Development and Social Welfare. He faced criminal proceedings under Sections 406 and 409 of the Indian Penal Code which became the basis for initiation of a departmental proceeding against the petitioner under Rule 10 of the West 2 Bengal Services (Classification, Control and Appeal) Rules, 1971. 5. The petitioner has, thereafter, been absolved all the charges in the criminal case. However, the departmental proceeding found the petitioner guilty of the charges and imposed a punishment on the petitioner sometime in 2014. 6. The petitioner is aggrieved that he has not been paid the provisional pension since his retirement on August 31, 2025. He is also aggrieved that his leave encashment has also not been paid. 7. The petitioner will make an application for such purpose before the added respondent no. 5 who will consider the same in accordance with law by September 15, 2026 and if found eligible will disburse the provisional pension and the leave encashment to the petitioner. 8. In view of the aforestated, the writ petition is disposed of. 9. There will be no order as to costs. 10. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Reetobroto Kumar Mitra, J.)
