JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Petitioner, daughter is before this Court seeking for parole of her father, CTP No.14309, V. Shivappa, who had been convicted for offences punishable under Sections 302, 143, 147, 148, 149 and 120B of the IPC, the highest of the sentence being for - 3 - HC-KAR CNR: KAHC010576682026 NC: 2026:KHC:44916 WP No. 26129 of 2026 imprisonment for life in S.C.No.57/2018 by the I Additional District and Sessions Court, Kolar. 2. The petitioner has been incarcerated for a period of 2 years, 5 months as on date. The reason why parole is now sought for is on account of the marriage of the petitioner-daughter. The Detenue has been sentenced for imprisonment for life and having served only 2 years and 5 months, I am of the opinion that the parole sought for cannot be granted at this stage. 3. However, taking into consideration that it is the marriage of his daughter which is to be celebrated on 26.08.2026 at 04.30 a.m., it will be required for the father to participate in the said wedding since it is the wish of the daughter that her father participates in the said wedding. 4. In that view of the matter, parole for 2 days is granted from 25.08.2026 to 26.08.2026. The - 4 - HC-KAR CNR: KAHC010576682026 NC: 2026:KHC:44916 WP No. 26129 of 2026 Detenue shall surrender to the Jail Authorities by 09.00 a.m. on 27.08.2026. 5. Hence, I pass the following: ORDER i. The writ petition is disposed of. ii. Respondent No.2-the Chief Superintendent, Central Prison, Bengaluru, is directed to release Shivappa (CTP No. 1430) on emergency parole for a period of 02 days on 25.08.2026 and 26.08.2026, subject to the following conditions. a) Respondent No.1 shall stipulate strict conditions as are usually stipulated to ensure return of the detenue to the gaol and that he shall not commit any other offence during the period of parole. - 5 - HC-KAR CNR: KAHC010576682026 NC: 2026:KHC:44916 WP No. 26129 of 2026 b) The Detenue shall surrender to the Jail Authorities by 09.00 a.m. on 27.08.2026. iii.
