JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question the registration of a crime in Crime No.92/2026 for the offences punishable under Sections 319(2), 320 and 318(3) of the BNS, 2023, pending before the Prl. Civil Judge (Senior Division) & CJM Court, Chikkamagaluru. 2. Heard Sri. Ashoka T., learned counsel appearing for the petitioners, Smt. Deepthi Alva, learned HCGP appearing for - 3 - HC-KAR CNR: KAHC010502162026 NC: 2026:KHC:40196 CRL.P No. 10948 of 2026 respondent No.1, Sri. K.M. Prabhu, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application under Section 359 read with Section 528 of the BNSS, 2023, which reads as follows: “COMPOUNDING APPLICATION UNDER SECTION 359 READ WITH SECTION 528 OF THE BNSS, 2023 The Petitioners (Accused Nos.1 and 2) and Respondent No.2 (Complainant) most respectfully submit as follows: 1. That the Respondent No. 2/ Complainant had lodged a First Information Report (FIR) in Crime No. 0092/2026 against the Petitioners at the Chikkamagaluru Town Police Station for alleged offences punishable under Sections 319(2), 320, and 318(3) of the Bharatiya Nyaya Sanhita (BNS), 2023. The matter is currently pending on the file of the Prl. Civil Judge (Sr. Div) & CJM Court, Chikkamagaluru. 2. That the genesis of the present dispute was predominantly civil and financial in nature, arising out of an interpersonal misunderstanding regarding the advancement of certain amounts towards an educational seat and the construction of a house belonging to Petitioner No. 1. The relationship between Petitioner No. 1 and Respondent No. 2 was primarily that of a client and a legal practitioner in a separate civil litigation. 3. That during the pendency of the above-captioned Criminal Petition, with the timely intervention of common friends, well-wishers, and respectable members of the society, both the parties have sat together and amicably resolved all their differences and monetary disputes out of court. - 4 - HC-KAR CNR: KAHC010502162026 NC: 2026:KHC:40196 CRL.P No. 10948 of 2026 4. That the Petitioners and Respondent No. 2 have arrived at a full, final, and comprehensive settlement by way of DD No.595492 for a sum of Rs.3,20,000/-. The Respondent No. 2 acknowledges that all outstanding accounts and grievances have been settled to his absolute satisfaction, and he has received the mutually agreed restitution/settlement amount in lieu of all his claims against the Petitioners. 5. That in view of the aforesaid amicable settlement, Respondent No. 2 unconditionally withdraws all allegations made against the Petitioners in the subject FIR. Respondent No. 2 explicitly states that he has no objection whatsoever to the quashing of the FIR in Crime No. 0092/2026 and all subsequent proceedings emanating therefrom against both Petitioners. 6. Both parties state and declare that this joint compromise has been entered into out of their own free will, volition, and mutual consent, without any force, coercion, threat, or undue influence from anyone whomsoever. 7. The parties are well aware of the legal consequences of this compromise and state that continuing the criminal proceedings would be a futile exercise and a severe abuse of the process of law, given that the underlying dispute has completely ceased to exist. PRAYER WHEREFORE, it is most respectfully prayed that this Hon'ble Court may be pleased to record this Joint Memo of Compromise and allow the present Criminal Petition by QUASHING the First Information Report and all entire proceedings in Crime No. 0092/2026 registered by the Chikkamagaluru Town Police Station for offences under Sections 319(2), 320, and 318(3) BNS, 2023, currently pending on the file of the Prl. Civil Judge (Sr. Div) & CJM Court, Chikkamagaluru, in the interest of justice and equity." - 5 - HC-KAR CNR: KAHC010502162026 NC: 2026:KHC:40196 CRL.P No. 10948 of 2026 4. The parties to the lis are present before the Court and are identified by their respective counsel. 5. In the light of application for compounding being filed and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioners in the subject petition. 6. For the aforesaid reasons, the following: ORDER i. Criminal Petition is disposed. ii. Proceedings in Crime No.92/2026 pending before the Prl.
