Sajid Shahbaz Khan Versus Union of India Mr. Angshuman Chakraborty Mr. S.S. Saha. …for the petitioner. Mr. Nadeem Sulaiman Mr. Tapan Bhanja Mr. Gourab Karmakar. …for the DRI Authority. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 3 months and the contraband recovered from the petitioner is 3397 grams of ganja as per the chemical examiner’s report. Learned advocate for the DRI opposes the prayer for bail. Having considered that the principle laid down in Barnali Bag Vs. Union of India (Special Leave Petition (Crl.) No.3641 of 2026) is applicable to the present case as the quantum recovery is of intermediate quantity, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. 2 Accordingly, the petitioner, namely, Sh. Sajid Shahbaz Khan shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, under NDPS Act, 8th Court, Barasat, 24 Parganas (North). If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of 24 Parganas (North) without prior permission of the learned special court. Additionally, the petitioner shall meet with the Deputy Director, DRI within a period of fortnight from date and thereafter on all subsequent dates fixed by the concerned officer. Thus, CRM(NDPS) 1735 of 2026 is allowed. Chemical examiner’s report submitted by the petitioner be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
