FIR in question was registered at the instance of complainant – Anil, father of the injured – Ashish. As per allegations, on receiving information regarding the occurrence, complainant reached the spot and found his son lying in a pool of blood near the house of Neeraj (petitioner herein), Jasbir (petitioner herein) and Devender. Thereafter, Ashish was taken to the hospital and, on the way, he disclosed to the complainant that Neeraj, Jasbir, Manjit and Devender had intercepted him in front of a wine shop and, with an intention to kill him, assaulted him on the face with a heavy beer bottle. The version recorded in the FIR reads as under:- “ Sir, I humbly Submitted that I am Anil Ajmer Singh, resident of village Kukar Kanda, Distt Kaithal. In our village, there is factionalism due to the election of Sarpanch due to which there is tension in the village. On 17-04-2026, at around 11.00 pm in the night, I received a phone call from Nirmal and he told me that injuries have been inflicted to your son Ashish by Neeraj, Manjit, Jasbir, Devendra and others. I reached the at the spot and found my son was lying in a pool of blood in front of the house of Neeraj, Jasbir and Devendra. Nirmal and Krishna were found there at the spot, they saved his life. I took my son to Kaithal Civil Hospital in the car of Nirmal. On the way, my son told me. Neeraj son of Wazir, Jasbir son of Satpal, Manjeet (Lalu) of village Alewa, Devendra son of Satpal, stopped me in front of wine shop at the Chowk on Mandwal Road which is in land village Rahda and all four of them together with the intention of killing me, hit me on my face with a heavy glass bottle of beer. Somehow I reached the village on my motorcycle. The road for my house passes in front of their house. I stopped the motorcycle in front of House of Krishna, so that they do not get to know. As I reached in front of their house, they attacked me. With the intention of killing me, Neeraj hit me on my cheek with a Barchhi, Majeet hit me in the eye with an iron digger and Jasbir hit me on the face with a iron rod and Devendra hit me above the neck with a broken glass bottle. After this Neeraj took out his revolver and tried to kill me but I was saved due to intervention of villagers and while leaving, he said that I will kill you and today these people saved you, saying this he become unconcious and has not regained consciousness till now. After this he was taken to Kaithal Civil Hospital. After giving necessary treatment the doctor seeing his critical condition referred him to Chandigarh PGI but he remained in critical condition and he is swinging between life and death. 20/04/2026 SD/-Anil Kumar Applicant Anil Singh Mobile no.9992434784.” JAWALA RAM 2026.07.22 19:21 I attest to the accuracy and authenticity of this document CRM-M-34807-2026 - 3 - 3. Today, learned State counsel has filed a status report dated 20.07.2026, along with the statements of the injured-Ashish and witness- Nirmal Singh, copy of the Medico-Legal Report along with the medical opinion, besides a pen-drive containing the CCTV footage of the occurrence, all of which are taken on record. Office is directed to tag the same at the appropriate place. A copy thereof has been handed over to the counsel for the petitioners. 4. On 20th May, 2026, following statement of injured Ashish (appended as Annexure R-1 along with status report) was recorded:- “Statement of Ashish, son of Shri Anil Kumar, resident of village Kukkarkanda, District Kaithal, Mobile No. - 9992434984. It is stated that I am a resident of the above address and my age is around 21 years. On 17-04-2026 at around 10:30 AM, I was coming from the field. On the way, Neeraj, Jasbir, Manjeet and Devender, after consuming liquor, stopped me in front of the liquor shop and all of them together attacked upon me with the intention of killing. In this attack, they used a beer bottle and rod on my face after drinking and then ran away with the intention of hitting me leaving half dead. After this, when I gained consciousness, my clothes were not on my body. I was somehow going home in the village, they beat me on the way and then again attacked with a sharp weapon and rod. Neeraj threatened to kill me by pointing a revolver at me, then some people of the village intervened and saved me, then Nirmal picked up me in his car and got admitted to Civil Hospital, Kaithal and took my family members along with him. Sd/- Ashish Dated 20.05.2026” 5. Statement of another witness, namely, Nirmal Singh, has also been appended with the aforesaid status report as Annexure R-2. Besides, as per the Medico-Legal Report, the injured reached the hospital at 00:20 hours JAWALA RAM 2026.07.22 19:21 I attest to the accuracy and authenticity of this document CRM-M-34807-2026 - 4 - on 18.04.2026. The injuries noticed in the Medico-Legal Report are reproduced here-under:- “ Sr. No. Injuries Marked Injury Number 1 THREE LACERATED WOUND OF EACH SIZE 3X1.5X1CM PRESENT ONE OVER BASE OF NOSE AND TWO OVER LEFT SIDE OF CHEEK BELOW EYE. ADVISE NCCT FACE AND SURGEON AND ENT OPINOIN No 1 2 C/O-PAIN AND LOOSINING OF RIGHT HALF OF UPPER QUADRANT OF TOOTH ADV NCCT FACE AND DENTAL OPINION No 2 3 C/O- PAIN PRESENT OVER LEFT SIDE DISTAL LEG, NO EXTERNAL INJURY MARK SEEN. ADV. X-RAY LEFT LEG AND ORTHO OPINION No 3 4 C/O-HEADACHE AND VERTIGO, NO EXTERNAL INJURY MARK SEEN. ADV NCCT HEAD AND SURGEON OPINION No 4 5 C/O-UPPER CHEST PAIN, NO EXTERNAL INJURY MARK SEEN. ADV NCCT CHEST AND SURGEON OPINION. No 5 6 MULTIPLE REDDISH BRUISE OF LARGEST SIZE 6X3CM AND 2X2CM PRSENT OVER RIGHT SIDE OF ARM. ADV X-RAY RIGHT ARM AND ORTHO OPINION No 6 ” 6. The doctor has opined that Injury No.1 is grievous in nature and caused by a sharp-edged object/glass bottle. As per the medical opinion, multiple facial fractures were detected on NCCT Face, on the basis whereof Injury No.1 was declared grievous in nature. In respect of Injury No.2, NCCT Face and dental opinion were advised. Thereafter, on 18.06.2026, Injury No.2 was also opined to be grievous in nature. 7. Heard. 8. Taking into consideration the specific role attributed to the petitioners, nature of injuries suffered by the injured – Ashish, particularly on the vital parts of his body, as well as the medical opinion declaring two injuries to be grievous in nature, this Court does not find any substantial ground to extend the concession of anticipatory bail to the petitioners.
