The prayers of the petitioners in this writ petition are as follows: 2026:JHHC:9363 2 “For issuance of appropriate Writ/ Order/ direction in the nature of certiorari, for quashing of order dated 19.01.2026 (Annexure-6) passed by Respondent No.4 whereby and where under, he has refused to register the sale deed dated 25.08.2025 executed by petitioner Nos. 1 to 3 in favour of petitioner No.4 for sale of 87 decimals of their raiyati land situated at khata No.6, plot No.632, thana No.99, mouza- Romi, Itkhori, Chatra, by arbitrary holding that the said land is Gair Majurwa aam land and is in the prohibited list; And/Or Upon quashing of order dated 19.01.2026 (Annexure-1) for Issuance of further direction upon Respondent No.4, particularly in the nature of mandamus directing him to forthwith register the sale deed dated 25.08.2025, as per law, executed by petitioner Nos. 1 to 3 in favour of petitioner No.4 for sale of 87 decimals of their raiyati land situated at khata No.6, plot No.632, thana No.99, mouza- Romi, Itkhori, Chatra, upon re-presentation at his office by the petitioners; And/Or For any other appropriate writ, order or direction that your lordships may deem fit and proper for doing conscionable justice to the petitioners under the facts and circumstances of the present case. 3. Learned counsel for the petitioners submits that the prohibited list has been set-aside by the Division Bench of this Court vide order dated 01.05.2025 passed in WP(C) No. 5088 of 2018, thus, the respondents have committed illegality by not registering the sale deed. 4. Today, an interlocutory application being I.A. No. 4648 of 2026 has been filed by the State that they will take appropriate action and in paragraph nos. 5 and 6 of the aforesaid I.A., they have stated as follows: 5. That the answering respondents-State and submit that the petitioners have raised the issue that the land is Raiyati land, whereas the deed has been refused stating that the land of pot no. 632 is recorded as "Gairmajarua Aam Aahar” which has been scrutinized and it has been found that the land sought to be transferred for which tenancy has been recognised as "Raiyati". The authorities are in process of rectifying the same. 6. That the answering respondents state and submit that the grievance of the petitioner is likely to be redressed within two weeks and the affidavit to this effect to be filed. 2026:JHHC:9363 3 5. The said interlocutory application is kept on record. 6. Considering the said statement, this writ petition is disposed of with the direction to the respondents to redress the grievance of the petitioners within two weeks. 7.
