Learned advocate for the State opposes the prayer for anticipatory bail as the Section which were applied in the said case are not similar to the provisions under which the investigation has been carrying out and charge-sheet has been submitted by the I.O. of the present case. 2 I have taken into account the statement of the victim in the case at Majhauli and I find that the said case was also registered under the provisions of the IPC, Immoral Traffic (Prevention) Act and POCSO Act. Having considered the fact that the petitioner has already suffered custody in respect of the investigation of the case where victim is the same, I am inclined to grant anticipatory bail to the present petitioner. Hence, the prayer for anticipatory bail of the petitioner is Allowed. Accordingly, I direct that in the event of arrest, the petitioner [Sanjeet Kumar @ Sanjeet @ Sandip @ Sandeep Soni] be released on anticipatory bail subject to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As charge-sheet has already been submitted in the present case, this order of anticipatory bail will remain valid for a period of six weeks from date. Accordingly, CRM (A) 809 of 2026 is disposed of.
