Heard the parties.
The petitioner has been made accused in connection with Nawadih P.S. Case No.39 of 2025 (S.T. No.326 of 2025) registered under Section 103 (1)/ 3 (5) of the B.N.S, 2023 and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner, in furtherance of common intention with the co- accused persons, committed the murder of the son of the informant namely Hemlal Pandit. It is submitted that the allegation against the petitioner is false. It is further submitted that the allegation of firing on Hemlal Pandit, is upon Vikash Singh and Doman Ram and the only allegation against the petitioner is that he came to the house of the informant for calling him. It is also submitted that the co-accused namely Champa Devi, has already been admitted to bail. Hence it is submitted that the petitioner be released on bail.
Learned Addl. P.P. appearing for the State vehemently opposes the prayer for bail and submits that apart from the P.W.1, the P.W.2 has categorically stated and identified the petitioner to be involved in commission of murder of Hemlal Pandit. It is next submitted that in view of the direct allegation of serious nature and the overwhelming evidence that has come against the petitioner during the trial, there is every chance of the petitioner absconding and tampering with the evidence if released on bail. It is also submitted that the allegation against the co-accused Champa Devi, stands on
different footing as the allegation against her is only of conspiracy and there is no allegation against her of actively participating in any of the act leading to the death of Hemlal Pandit. It is, therefore, submitted that the petitioner ought not be released on bail at this stage.
Considering the serious nature of allegation against the petitioner as well as his chance of absconding and tampering with the evidence, if released on bail, this Court is of the considered view that this is not a fit case where the above-named petitioner be released on bail. Accordingly, the prayer for bail of the above-named petitioner is rejected at this stage.
