Accused in Crime No.108 of 2026 registered by J.C. Nagar Police Station, Bengaluru City for offences punishable under Sections 8 and 12 of POCSO Act, 2012 is before this Court in this petition filed under Section 483 of the BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the petitioner and learned HCGP on behalf of respondent no.1 - State. Respondent no.2 who is served in the matter has remained unrepresented before this Court. 3. FIR in Crime No.108 of 2026 was registered by J.C. Nagar Police Station, Bengaluru City for the aforesaid offences against the petitioner, based on the first information dated 25.05.2026 received from respondent no.2, who is the mother of the victim girl. In the said case, petitioner was arrested on 25.05.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.5289 of 2026 was rejected on 15.06.2026. In the first information dated 25.05.2026, mother of the victim has averred that on 11.05.2026, petitioner had offered chocolate and money to the victim girl and thereafter, all of a sudden he had hugged and kissed her. He also allegedly touched her private parts inappropriately and it is under these circumstances, FIR was registered against the petitioner. In the said case, petitioner is in custody for the last more than two months. Investigation of the case is now completed and charge sheet is filed. Maximum punishment for the alleged offences is imprisonment for a period of five years. Petitioner aged 51 years has no other criminal antecedents. Under the circumstances, following:- ORDER Criminal petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.108 of 2026 registered by J.C. Nagar Police Station, Bengaluru City for offences punishable under Sections 8 and 12 of POCSO Act, 2012, subject to the following conditions:- a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh - 4 - HC-KAR CNR: KAHC010419582026 NC: 2026:KHC:40505 CRL.P No. 8993 of 2026 only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future.
