The present petitioners before this Court are related to the deceased in the following manner: petitioner no.1 is the father- in-law, petitioner no.2 is the mother-in-law, petitioner no.3 is the sister-in-law and the petitioner no.4 is the brother-in-law (brother of the husband). Learned senior advocate at the inception draws the attention of the Court to the order passed in CRR 3142 of 2025 wherein a co-ordinate Bench of this Court was pleased to stay the order issuing proclamation and attachment so far as the present petitioners are concerned, consequently, the present application under Section 482 of the BNSS was preferred before this Court. Records reflect that charge-sheet was submitted in the
2 year 2025. The husband of the deceased was arrested in connection with the instant case and subsequently released on bail. Evidence has been progressed in this case and almost 15 witnesses were examined. Learned advocate for the State opposes the prayer for anticipatory bail. I have taken into account the fact that the petitioners in September, 2025 expressed their intention to join the trial, as such, approached the revisonal court with a prayer. Having regard to the fact that till date the police authorities were not in a position to trace out the present accused persons and the petitioners having expressed their intention to join the trial, I am inclined to extend the relief under Section 482 of the BNSS. Accordingly, the prayer for anticipatory bail of the petitioners, namely, Manulla Sk., Nila Begum, Chumki BIbi and Suman Sk. alias Rahul are allowed. Learned senior advocate appearing for the petitioners submits that the petitioners have expressed the intention to surrender before the learned trial court within a period of six weeks from date. In the aforesaid circumstances, the prayer of the petitioners are allowed.
In the event the petitioners appear before the learned trial court, the learned trial court on appropriate terms and conditions would release the petitioners as it deems fit and proper. With the aforesaid observations, CRM(A)4333 of 2025 is
3 allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
