Memo of evidence, filed by the State in Court today, be kept with the record. 2. Learned Counsel appearing on behalf of the petitioner submits that the petitioner is the husband of the de facto complainant. Earlier, one criminal case was initiated against him under Sections 85/150(2) of the Bharatiya Nyaya Sanhita, 2023 and Sections 3/4 of the Dowry Prohibition Act. In the said case, he was granted anticipatory bail by the Sessions Judge, Purulia. One month after getting the anticipatory bail, the present case was registered against him falsely although he was not involved in the alleged offence. He prays for anticipatory bail on any terms and conditions. 2
3. Learned Advocate appearing for the State opposes the prayer for anticipatory bail and produces the Memo of Evidence as well as the Case Diary. 4. Having heard the submission of the respective parties and on perusal of the materials on record and case diary, this Court finds that this is a fit case for allowing the anticipatory bail since there is no need of custodial interrogation. 5. As such, the prayer for anticipatory bail of the petitioner, namely, MILAN SINGHBABU is allowed. 6. Accordingly, in the event of arrest, the petitioner shall be released on bail to the satisfaction of the arresting officer on the terms and conditions as he deems fit and proper and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita,
2023. 7. In the event the petitioner fails to comply with any of the conditions mentioned above, the prosecution shall be at liberty to pray for cancellation of the anticipatory bail granted by this Court in accordance with law. 8.
The application for anticipatory bail being CRM(A) 2094 of 2026 is, thus, allowed. 9. All concerned parties shall act on the server copies of this order duly downloaded from the official website of this Court. 10. Concerned Department is directed to supply urgent certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities. (Ajay Kumar Gupta, J.)
