JUSTICE E.S.INDIRESH ORAL ORDER In this petition, petitioners are challenging the order dated 03rd April, 2007 (Annexure-A) passed by the respondent No.1 in Case No.RA.58/2003-04 and order dated 16th December, 2002 (Annexure-B) passed by the respondent No.2; inter alia sought for direction to the respondents 1 to 3 to restore the revenue records in to the name of petitioners in respect of subject land. - 3 - HC-KAR CNR: KAHC010081222025 NC: 2026:KHC:43374 WP NO.4151 OF 2025 2. Heard Sri. Prabhugouda Tumbigi Basavantarayagouda, learned counsel appearing for petitioners and Smt. B.P. Radha, learned Additional Government Advocate appearing for respondents. 3. Having heard the learned counsel appearing for the parties, on perusal of the impugned orders passed by the respondents 1 and 2, it is forthcoming that the respondent- Authorities have cancelled the grant made as per Saguvali Chit dated 14th March, 2002 in favour of the father of petitioners. The reason assigned by the respondents 1 and 2 in the impugned orders for canceling the grant made in favour of the father of petitioner is that, the father of petitioners is not cultivating the land from ten years. In this regard, on perusal of the Grant Certificate produced at Annexure-G would indicate that the father of petitioners was cultivating the subject land and that apart, the Grant Certificate has been issued to the father of the petitioner, after verifying and conducting the spot inspection by the competent Committee as to the cultivation. On perusal of RTC Extracts for the year 2002-03, it is forthcoming that the name of the father of petitioners is shown - 4 - HC-KAR CNR: KAHC010081222025 NC: 2026:KHC:43374 WP NO.4151 OF 2025 at column No.9 of the RTC. Therefore, the reason assigned by the respondents for canceling the grant made in favour of father of petitioners is contrary to law and accordingly, same deserves to be set-aside. Hence, I pass the following: O R D E R (i) Writ Petition allowed; (ii) Order dated 03rd April, 2007 (Annexure-A) passed by the respondent No.1 in Case No.RA.58/2003-04 and order dated 16th December, 2002 (Annexure-B) passed by the respondent No.2 are hereby set-aside; (iii) Respondents are directed to restore the name of petitioners in the revenue records in respect of the subject land, within an outer limit of two months from the date of receipt of this order.
