Learned advocate appearing for the petitioner submits that out of 20 witnesses to be examined, prosecution till date has examined 6 witnesses and some of the witnesses already have turned either hostile or has expressed their ignorance regarding the substance of the accusation.
State has opposed the prayer for bail and submitted a report before this Court.
Records reflect that 14 more witnesses are yet to be
2 examined by the prosecution which will take substantial amount of time. Having regard to the period of detention and the fact that there are no antecedents of the present petitioner, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed.
Accordingly, the petitioner, namely, Nayan Sk shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned CJM, Berhampore, Murshidabad. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Murshidabad without prior permission of the learned trial court.
Thus, CRM(M)1222 of 2026 is allowed.
