1. Following reliefs have been prayed in this petition:-
“10.1 That, this Hon'ble Court may kindly be pleased to call for entire records of the case, from the authorities. 10.2 That, this Hon'ble Court may kindly be please to quash the order dated 15.07.2026 passed by respondent no. (Annexure-P/1) in E-court case no. 202606320600012/B- 121/2025-26, between "State of Chhattisgarh Vs. President, Vrindawati Mahila Swa Sahayata Samuh Sankra" is in the interest of justice. 10.3 That, this Hon'ble Court may kindly be please to direct to the respondent no. 3 to provide fair opportunity of the hearing, is in the interest of justice. 10.4 That, any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the costs of the petition may be given.”
2. Learned counsel appearing for the petitioner as well as learned Panel Lawyer appearing for the respondents submit that, in view of the order dated 04.08.2026, the concerned Sub-
3 Divisional Officer (Revenue) has filed an affidavit explaining the circumstances in which the order dated 15.07.2026 came to be passed.
3. Upon consideration of the explanation offered by the concerned Sub-Divisional Officer (Revenue), this Court finds that the explanation furnished is not satisfactory and cannot be accepted. However, it has been stated in the affidavit that the order dated 15.07.2026 shall be recalled and a fresh order shall be passed strictly in compliance with the directions issued by this Court vide
order dated 14.07.2026 passed in WPC No. 3654 of 2026.
4. In view of the aforesaid statement made on behalf of the respondents, and since the petitioner is primarily aggrieved by the
order dated 15.07.2026, the present petition is disposed of with a direction to the concerned Sub-Divisional Officer (Revenue) to recall the order dated 15.07.2026 and pass a fresh, reasoned and speaking order strictly in accordance with law.
5. While passing the fresh order, the concerned Sub-Divisional Officer (Revenue) shall afford due and effective opportunity of hearing to the petitioner and shall ensure strict compliance with the directions contained in the order dated 14.07.2026 passed by this Court in WPC No. 3654 of 2026, in its letter and spirit.
6. It is made clear that if, on any subsequent occasion, it is found by this Court that the concerned Sub-Divisional Officer (Revenue)
4 has passed any order without taking into consideration or complying with the directions issued by this Court, the Court shall pass appropriate adverse or punitive action against the concerned officer, in accordance with law.
7. With the aforesaid directions, the present writ petition stands
