JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Petitioner is before this Court seeking for the following reliefs: "a. Issue writ of certiorari or in the nature thereof or any other appropriate writ, quashing the impugned order in case No.MAG-1/HASSAN/EXTERNMENT/11/ 2026 dated 27.07.2026 (Annexure-A) passed by respondent No.1. b. Pass such an order which is deemed to be fit in the nature and circumstances of the above case, in the interest of justice and equity." 2. The grievance of the petitioner is that though notice under Section 55 of the Karnataka Police Act, 1963 had been served on the petitioner, the report of respondent No. 1 was not enclosed along with the said notice and it is for that reason that the petitioner could not appear before the respondent No. 1 on 23.07.2026 resulting in the impugned order being passed on 27.07.2026. - 3 - HC-KAR CNR: KAHC010559242026 NC: 2026:KHC:43744 WP No. 25450 of 2026 3. Even if the report had not been available to the petitioner, it was for the petitioner to have appeared on 23.07.2026 and requested for copy of the report rather than not appearing before respondent No. 1 on 23.07.2026. However, considering that the matter relates to externment of the petitioner which has a impact on the life and liberty of the petitioner, in the interest of justice, this Court passes the following: ORDER (i) Certiorari is issued. The order at Annexure-A dated 27.07.2026 is quashed. (ii) The petitioner shall appear before respondent No. 1 without requirement of any further notice on 24.08.2026 at 02.30 p.m., when he shall be furnished with the report of respondent No.1. (iii) The petitioner ought to be provided an opportunity to go through the same and make his submission on a date fixed by respondent No. 1 and after hearing the petitioner, respondent No.1 is directed to pass necessary orders in accordance with law. - 4 - HC-KAR CNR: KAHC010559242026 NC: 2026:KHC:43744 WP No. 25450 of 2026 4.
