The present writ petition has been filed for following reliefs:- (I) That the Hon'ble High Court may kindly be pleased to direct Respondent No. 2, Cмно Balodabazar-Bhatapara (C.G.), to decide the representation of the petitioner dated 01.06.2026. (Annexure P/4) for revocation of the JYOTI SHARMA Digitally signed by JYOTI SHARMA Date: 2026.08.25 16:53:34 +0530 2 / 3 petitioner's suspension and also for release of full salary of the petitioner from the date of suspension, dated 15.04.2026, to the date of reinstatement of the petitioner. (ii) That this Hon'ble Court may kindly be pleased to give suitable compensation to the petitioner for the mental trauma and agony, harassment and hardships suffered by him as also cost of the litigation. 2. Learned counsel for the petitioner submits that the petitioner was working on the post of Driver and was placed under suspension vide order dated 15.04.2026. He further submits that the petitioner was arrested on 13.04.2026 in connection with Crime No. 0169/2026 registered at Police Station Kasdol, District Balodabazar-Bhatapara for the offences punishable under Section 64 (1) of the Bhartiya Nyaya Sanhita, 2023. He submits that the petitioner has already submitted a representation (Annexure P-4) seeking revocation of suspension, however, the same is still pending consideration before the competent authority. He, therefore, prays for a direction to the concerned authority to consider and decide the said representation within a stipulated period. 3. Learned State counsel submits that if the representation submitted by the petitioner is pending consideration, the same shall be examined and decided by the competent authority in accordance with law, keeping in view the applicable circulars/instructions of the State Government as well as the law laid down by the Hon'ble Supreme Court, within a reasonable period. 4. Heard learned counsel for the parties and perused the material available on record. 3 / 3 5. Considering the limited prayer made by learned counsel for the petitioner and without expressing any opinion on the merits of the case, this petition is disposed of with a direction to respondent No. 2 to consider and decide the petitioner's representation (Annexure P-4) in accordance with law, on its own merits, expeditiously, preferably within a period of 30 days from the date of receipt of a certified copy of this order. 6. It is made clear that this Court has not expressed any opinion on the merits of the claim of the petitioner and the competent authority shall take an independent decision strictly in accordance with law. 7.
