Mr. Gunjan Shah, Ms. Shreya Agarwal …for the petitioner In this application, petitioner is aggrieved by the inordinate delay caused in disposal of her interim maintenance application filed under Section 144 of the BNSS and thereby seeking to pass a direction upon the Court below for expeditious disposal of the said application. Being aggrieved by the delay caused in the said proceeding, learned Counsel for the petitioner submits that the petitioner preferred an application under the proviso to Section 144(1) of the BNSS seeking interim maintenance in the month of January, 2026. Said prayer for interim maintenance is still pending for disposal. Therefore, she prayed for necessary direction upon the Court below. Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application, the opposite party will have no cause to prejudice and, as such, service of copy of application upon the opposite party is dispensed with. Having considered submission made on behalf of the petitioner, I find that the prayer made by the petitioner is justified and is required to be allowed to secure the ends of justice. In view of above, let the CRR 2867 of 2026 is hereby disposed of with a direction upon the Court below to make every endeavour for 2 expeditious disposal of the interim maintenance application filed by the petitioner and to make his best effort to dispose of the said application preferably within a period of three months from the next date of hearing and thereafter he will make his best effort to conclude the hearing of the proceeding at the earliest.
