14 0077..0088..22002266 Ct. No. 05 adeb WPA 18370 of 2026 Somnath Patra Vs. The State of West Bengal & Ors. Mr. Dinesh Pani Ms. Sulagna Sen ….for the petitioner Mr. Udayan Chakraborty Mr. Nripendra Pratap Singh …for the State Mr. Milan Kumar Maity Mr. Pratap Kumar Yadav …for the respondent nos. 6 & 7 1. Affidavit of service filed on behalf of the petitioner is taken on record. 2. Learned advocate representing petitioner submits that due to acts and actions of private respondents petitioner’s right to ingress and egress to his property is being impacted thereby prompting the petitioner to approach this Court with the present writ petition seeking direction upon the concerned police authorities to take steps accordingly. 3. State respondents and respondent nos. 6 and 7 are represented by learned advocates and submission is made based on order passed by appellate authority under the West Bengal Acquisition of Homestead Land for 2 Agricultural Labourers, Artisans and Fishermen Act, 1975. 4. It is submitted on behalf of the petitioner that contention made before the appellate authority was accepted and order was passed in favour of the petitioner but subsequently petitioner’s right to ingress and egress is obstructed. 5. If it is found by the petitioner that in spite of aforesaid order dated 12th October, 2023 petitioner’s right is denied so far property in question, petitioner needs to approach appropriate forum in pursuit of remedy. Police authority is not the appropriate authority to decide right of petitioner to ingress and egress. 6. Hence, present writ petition is not interfered with and same stands dismissed. 7. However, this order shall not preclude the petitioner to take steps in accordance with law. 8. Parties to act on the server copy of this order duly downloaded from the official website of this Court.
