This writ petition was filed alleging inaction on the part of the respondents CESC authorities in taking steps for removal of hazardous electrical wiring and meter to a safer zone and/or common place in on around premises no. 42, Rani Rashmoni Road. 2. The petitioner had approached this Court earlier by filing WPA 24046 of 2023 wherein, CESC Limited had filed a report indicating that shifting of the meter was technically not feasible. 3. The said writ petition was ultimately disposed of by an order dated September 09, 2025 passed by a Co- ordinate Bench of this Court directing the respondent no. 5 therein to relocate the internal wiring from the petitioners’ shop premises within a period of two weeks from the date of the order. The respondent no. 5 was also directed to pay costs to 2 the tune of Rs. 5000/- (Five Thousand) to the petitioners within a period of two weeks. 4. On July 14, 2026 when the matter was taken up, it was submitted on behalf of the respondent no. 6 herein (who was the respondent no. 5 in WPA 24046 of 2023) that although the said respondent was ready and willing to relocate the wiring in terms of the order dated September 09, 2025, yet the same could not be done because of the non co- operation of the petitioners. On that date, this Court put the parties on notice that in case the electrical wiring was not relocated because of latches on the part of the respondent no. 6 or non co-operation of the petitioners, the Court would be constrained to direct disconnection of electricity supply of the erring party or, if necessary, both the parties. 5. Today, it is submitted by the petitioners as well as the private respondent no. 6 that the relocation of the wiring in terms of the order dated September 09, 2025 has been completed and the petitioner has also revamped the wiring. 6. It is further submitted by both the parties that the private respondent no. 6 has already paid costs to the tune of Rs. 5000/- (Five Thousand) to the petitioner in terms of the said order dated September 09, 2025. 7. In such view of the matter, nothing further remains 3 to be ordered on this writ petition. 8. Accordingly, WPA 15004 of 2026 stands disposed of. No Costs. 9. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Om Narayan Rai, J.)
