P.P. …...... 03/ 02.04.2026: This bail application has been filed by the petitioner under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Section 47A of Excise Act. 2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order. 3. Learned counsel for the State opposes the prayer for bail. 4. The petitioner is in custody since 28.11.2025 in connection with Complaint Case No.40289 of 2025. The case arises out of a complaint filed under Section 47A of the Excise Act where there is an allegation that from the godown huge quantity of liquor was recovered. It is the case of the petitioner that the godown does not belong to the petitioner as he was merely an employee. Since this case is only under Section 47A of the Excise Act, thus complaint is filed and there is no question of police investigation. Cognizance has already been taken in this case and the petitioner has been stated that there is no criminal antecedent against the petitioner. 5. Considering the aforesaid fact, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Ranchi, in connection with Complaint Case No.40289 of 2025, subject to the condition that one of the bailors should be a close relative of the petitioner, having sufficient landed property in his/her own name within the State of Jharkhand with a further condition that the petitioner shall appear and mark his attendance before the Registrar, Civil Court, Ranchi once in a month till the disposal of the trial.
