Appearance:- Mr. Abhijit Ray, Adv. Ms. S. Nandy, Adv. …for petitioner. The Court:- Affidavit of service is taken on record. The petitioner has preferred the present petition under Section 29A of the Arbitration and Conciliation Act, 1996, seeking extension of the mandate of the arbitral tribunal for conclusion of the arbitral proceedings and publication of the arbitral award. This Court, vide order dated 15.03.2023, appointed a learned arbitrator to adjudicate the disputes between the parties. The pleadings were completed on 21.05.2024. Thereafter, with the consent of the parties, the mandate of the arbitral tribunal was extended for a period of six months up to 21.11.2025.Since the mandate of the arbitral tribunal had already expired, the petitioner seeks an extension of the mandate for a further period of eight months to enable the arbitral tribunal to conclude the proceedings and publish the award. It is further submitted that the petitioner had initially filed AP/195/2025 on the Non Commercial Side inadvertently, which, by an 2 order dated 17.12.2025, was permitted to be withdrawn with liberty to file appropriate proceedings, in accordance with law. Hence the Petitioner preferred the present Petition. The arbitral tribunal has already conducted 24 hearing.The pleadings in the arbitration have already been completed and the arbitral proceedings have substantially progressed. However, an application for amendment remains to be decided. Upon consideration of the submissions of the parties and the materials placed on record, this Court is satisfied that there has been no undue or unwarranted delay on the part of the learned sole arbitrator in conducting the arbitral proceedings. Having regard to the advanced stage of the proceedings and in the interest of justice, the mandate of the learned sole arbitrator is extended for a further period of eight months from today. The learned sole arbitrator is requested to make all reasonable endeavours to conclude the arbitral proceedings and publish the arbitral award within the extended time period.
