Accused in Crime No.329/2026 registered by Hebbagodi Police Station, Bengaluru City, for the offences punishable under Sections 109, 352 of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.329/2026 was registered by Hebbagodi Police Station, Bengaluru City, for the aforesaid offences against unknown persons based on the first information dated 27.06.2026 received from Abhishek who is the injured victim in the present case. During the course of investigation, petitioner was arrested on 27.06.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.5329/2026 was rejected on 10.07.2026. Therefore, petitioner is before this Court. 4. A reading of first information would go to show that parents of the victim are running a hotel and on the alleged date of incident, a customer who came to the hotel had ordered - 3 - HC-KAR CNR: KAHC010490732026 NC: 2026:KHC:44387 CRL.P No. 10540 of 2026 for Dosa and Chicken. Since the food ordered was not served within a reasonable time, he allegedly abused the victim and his mother, and thereafter, assaulted him with a knife and caused injuries. 5. Petitioner is arrested in the present case on 27.06.2026 and remanded to judicial custody. The records made available would go to show that after he was arrested, he was subjected to medical examination and it appears that even the petitioner had suffered an injury on his hand in the alleged incident in question. The victim who was admitted in the hospital has been now discharged. His medical records would go to show that he was on the hospital for a period of three days from 26.06.2026 onwards. Petitioner had no ill-will or motive against the injured victim. He has no other criminal antecedents. Major portion of the investigation is already completed. Under the circumstances, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order: 6. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.329/2026 registered by Hebbagodi - 4 - HC-KAR CNR: KAHC010490732026 NC: 2026:KHC:44387 CRL.P No. 10540 of 2026 Police Station, Bengaluru City, for the offences punishable under Sections 109, 352 of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
