1. Heard Mr.Shivraj Singh, learned counsel for the petitioners as well as Mr.Jitendra Shrivastava, learned Government Advocate appearing for respondent No.1/State and Mr.Vivek Siddharth Ojha, learned counsel appearing for respondent No.2.
2. By way of this petition under Section 528 BNSS the petitioners have prayed for following relief:-
“It is, therefore, prayed that this Hon'ble Court may kindly be pleased to quash and set aside the entire criminal proceedings including the order taking cognizance dated 19.06.2026 (Annexure P/1) passed by the Ld. Judicial Magistrate First Class, Ambikapur District Surguja (C.G.) in Criminal Case No. 6746 of 2026 and the chargesheet no. 4/2026 dated 18.06.2026 (Annexure P/2) along with FIR no. 5/2026 dated 15.05.2026 filed by the Respondent No.1 in relation to commission of alleged offence under Sections 498A, 294, 323 and 34 of the Indian Penal Code, 1860, in the interest of justice.”
3. It transpires from the record that this Court vide order dated 3.8.2026 referred the matter to the Mediation Centre of this Court for mediation of the dispute.
4. It has been argued by the learned counsel for the petitioners that in pursuance of the order dated 3.8.2026, parties i.e. petitioners- Ritayu Jaiswal, Sanjay Jaiswal & Rachna Jaiswal and respondent
3 No.2-Avantika Jaiswal have appeared before the Mediation Centre of this Court on 14.08.2026, wherein all the disputes and differences of the parties have been amicably settled by them through the process of Mediation Centre, therefore, in view of the law laid down by the Apex Court in Manoj Sharma Vs. State, (2008) 16 SCC 1, B.S. Joshi Vs. State of Haryana & others, (2003) 4 SCC 675 and Gian Singh Vs. State of Punjab & another, (2012) 10 SCC 303, the impugned FIR and criminal proceedings be quashed.

Learned counsel appearing for respondent No.2 could not dispute the aforesaid facts.

From perusal of the mediation report dated 14.08.2026, it transpires that both the parties, i.e. petitioners and respondent No.2, have mutually agreed to resolve their disputes amicably in terms and conditions as mentioned in the settlement/agreement dated 14.08.2026, which is on record and the Registrar (S & A)- cum-In-Charge (Mediation) has also certified the said fact.
7. Keeping in mind the ratio laid down by the Apex Court in Manoj Sharma (supra), B.S. Joshi (supra) and Gian Singh (supra) and also taking into consideration that the dispute between the parties from which the impugned FIR and criminal proceedings have emanated have been amicably settled before the Mediation Centre of this Court vide settlement/agreement dated 14.08.2026 and the parties have agreed to abide the said
4 settlement/agreement dated 14.08.2026, this Court is of the view that no useful purpose would be served in proceeding any further against the petitioners in this matter.

In that view of the matter, criminal proceedings pending before the Judicial Magistrate First Class, Ambikapur, District Surugja in Criminal Case No.6746/2026 arising out of the FIR No.5/2026 dated 15.05.2026 lodged by respondent No.2 against the petitioners for offence under Sections 498A, 294, 323 and 34 of the IPC and chargesheet No.4/2026 dated 18.06.2026 are hereby quashed, subject to fulfillment of terms and conditions as mentioned in the settlement/agreement dated 14.08.2026 arrived at between the parties before the Mediation Centre of this Court.
