Mr. Sandip Das Mr. Sajal Bhattacharya ….for the petitioner Mr. Deb Kumar Chanda Mr. Saikat Dey ……for the State respondents 1) Affidavit of service filed on behalf of the petitioner is taken on record. 2) From the case made out in writ petition it appears that petitioner is being prevented from cultivating land in question prompting the petitioner to approach this Court with the present writ petition seeking direction upon the concerned police authorities to take steps which would facilitate the petitioner to cultivate land in question. 3) State respondents are represented by learned advocate but respondent no. 4 is not represented. 4) Having considered the case made out in writ petition it appears that petitioner prays for issuance of mandamus directing the concerned police authorities to take steps for preserving right of the petitioner over 2 land in question. Issue involved in this writ petition is civil in nature requiring the petitioner to approach appropriate forum. Police authority is not the appropriate authority to decide right of the parties over land in question. 5) Hence, writ petition stands dismissed. 6) However. petitioner shall be at liberty to approach appropriate forum in pursuit of remedy. 7) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
