Learned advocate for the petitioner submits that the petitioner is innocent and has been foisted with the criminal case. Even if the accusations made in the letter of complaint is accepted on its face value, no case under the relevant provisions of SC & ST (POA) Act has been made out. Learned Pubic Prosecutor appearing for the State challenges the maintainability of the present application. I find that the accusation is in a public place. Accordingly, the provisions of Section 18-A sub-Clause (2) of SC & ST (POA) Act is attracted. As such, the prayer for anticipatory bail is 2 not maintainable. Consequently, CRM(A)1074 of 2026 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
