Present petition has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking the concession of regular bail in FIR No. 170 dated 16.07.2024, registered under Sections 21(c), 25 and 29 of the NDPS Act and Sections 25, 54 and 59 of the Arms Act at Police Station Gharinda, District Amritsar. 2. As per prosecution case, alleged recovery in the present case is 07 kg 02 grams of Heroin along with four pistols from the possession of the petitioner, whereas from co-accused-Jagwat Singh, one pistol of .32 bore was recovered. Out of the total 23 prosecution witnesses, none has been examined till date. Though the delay in recording the prosecution evidence may be attributable to the witnesses, jail authorities, or counsel appearing for either side, however, considering the huge quantity of RASHMI 2026.07.23 10:23 I attest to the accuracy and integrity of this document CRM-M-12672-2026 2 contraband allegedly recovered and recovery of firearms, this Court does not find any substantial ground to consider the prayer for grant of bail to the petitioner at this stage, particularly when the trial is still at the initial stage. Petition stands disposed of. 3. Before parting with this order, learned Trial Court is directed to make earnest efforts for expeditious conclusion of the trial. In case prosecution fails to cooperate in the proceedings, Trial Court shall take an appropriate view against the concerned police officials and also forward necessary information to the Senior Superintendent of Police, Amritsar (Rural), for taking suitable action. 4. Let copy of this order be forwarded to the Trial Court concerned as well as the Senior Superintendent of Police, Amritsar (Rural), for information and necessary compliance.
