WasimAkram Ms. S. Parveen … for the Petitioner(s) Mr. Rajendra Banerjee, APP Mr. Ramashis Mukherjee … for the State-respondent(s) Learned advocate for the petitioner submits that the subject-matter of the case relates to alleged recovery of 26 bottles of Eskuf cough syrup and so far as the present petitioner is concerned, there is no recovery from the present petitioner and he has been implicated in the case only on the basis of statement of a co-accused. Mr. Banerjee, learned APP, appears for the State along with a junior of his choice as per the direction of this court. The appointment of both Mr. Das and the junior of his choice, if any, be regularized by the concerned authority. Learned advocate for the State opposes the prayer for bail. 2 The records of the case reflect that charges-sheet has already been submitted before the learned jurisdictional court. In view of the aforesaid, I am inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Md Rafik Sk @ Rafik Sk shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under NDPS Act, 3rd Court, Malda. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of Malda without prior permission of the learned Special court/ trial court. Accordingly, CRM (NDPS) 1062 of 2026 is allowed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. 3 Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
