Crl.O.P.(MD).No.10447 of 2026
ORDER The present Criminal Original Petition has been filed by the respondents 1 to 3 in D.V.C.No.76 of 2025, on the file of the Additional Mahila Court (Magistrate Level), Thanjavur District, seeking to transfer the same to the file of the learned Judicial Magistrate No.II, Poonamalle at Tiruvallur District.
2. The primary contention of the learned counsel appearing for the petitioners is that the petitioners 1 and 3 herein are visually challenged persons and the second petitioner is aged about 75 years old and she finds it difficult to travel from Tiruvallur to Thanjavur.
3. A perusal of the medical records reveal that the petitioners 1 and 3 are visualy challenged persons and considering the fact that the second petitioner (Mother – in – law of the complainant) is 75 years old, this Court is of the considered opinion that their presence before the Additional Mahila Court (Magistrate Level) at Thanjavur shall be dispensed with unless specifically directed by the trial Court. 2/4 https://www.mhc.tn.gov.in/judis

4. Taking into consideration the fact that the first respondent/wife is permanently residing at Thanjavur, transfer of the case would cause inconvenience to the respondent and therefore, this Court is of the considered opinion that granting dispense with the appearance of the petitioners herein would meet the ends of justice.
5. With the above said observation, this Criminal Original Petition stands disposed of. Consequently connected Miscellaneous Petitions are closed.
