JUSTICE M.G.S. KAMAL ORAL ORDER 1. Petitioner, who was admittedly sanctioned a loan of Rs.100 lakhs by respondent No.2-Corporation in terms of Sanction Letter dated 04.07.2018 (Annexure-A), is before this Court being aggrieved by the demand notices raised by respondent-Corporation seeking repayment of the loan amount. 2. The impugned demand notices are dated 02.03.2021 as per Annexure-K and 06.04.2021 as per Annexure-M, in terms of which a sum of Rs.7,56,273/- and Rs.3,29,671/- respectively have been demanded. Petitioner has disputed the same. 3. Learned counsel for the petitioner submits that the petitioner's only grievance is that the demand so raised is not in consonance with the contractual terms and actual amount due and payable by the petitioner. Therefore, he submits that, if an opportunity is granted to the petitioner to submit a memo of calculation to the respondents and - 4 - HC-KAR CNR: KAHC010435482021 NC: 2026:KHC:41465 WP No. 21044 of 2021 the respondents are directed to look into the memo of calculation, and then raise the demand, the purpose of the petition would be served. 4. Learned counsel appearing for the respondent- Corporation submits that the petitioner is at liberty to furnish memo of calculation in accordance with the terms of the Sanction Letter and the loan disbursement documents and the same shall be considered by the respondent-Corporation. Thereafter, appropriate action for recovery in accordance with law shall be taken. 5. Based on submissions made and material available on record, the petitioner is at liberty to submit a memo of calculation pointing out the actual due payable, according to the petitioner. Respondent-Corporation shall consider the same and thereafter, proceed in accordance with law. 6. At this juncture, learned counsel for the petitioner also seeks for quashing of impugned demand notices, which is opposed by learned counsel for the respondent- Corporation. - 5 - HC-KAR CNR: KAHC010435482021 NC: 2026:KHC:41465 WP No. 21044 of 2021 7. The cause of action for filing of the petition is mere issuance of demand notices as noted above. Proper course for the petitioner was to reply to the said notices placing on record her case, instead has approached this Court by filing the present writ petition, which is pending since 2021. 8. Since petitioner is intending to submit her calculation of outstanding, and respondent-Corporation has agreed to consider the same and arrive at its own calculation, no purpose will be served with the impugned notices. 9. In that view of the matter, the respondent-Corporation after consideration of the calculation to be submitted by the petitioner as noted above, is at liberty to issue a fresh notice of demand and shall proceed in accordance with law. 10. No contentions with regard to limitation shall be raised by the petitioner thereafter.
