This is the <rst bail application <led under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023, for grant of regular bail to the applicant who has been arrested in connection with Crime No. 248/2026 registered at Police Station- Aarang, District- Raipur (C.G.), for the o=ence punishable under Sections 4, 6 and 10 of the Chhattisgarh Agricultural Cattle Preservation Act, 2004.
2. Case of the prosecution, in brief, is that while the police team of Police Station Aarang was on patrolling duty, they received information that some persons were transporting cattle in a Mazda KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN
2 vehicle bearing Registration No. UP-83-CT-8790 from Village Gudguda. Acting upon the said information, the police intercepted the vehicle and allegedly found 19 cattle being transported therein in an inhumane manner without proper arrangement of food and water. It is alleged that the cattle were stu=ed inside the vehicle and no valid documents regarding their transportation were produced. Consequently, the present applicant and other co-accused persons were arrested and the aforesaid o=ence was registered against them.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case and has not committed any o=ence as alleged by the prosecution. It is submitted that, prima facie, no o=ence under Sections 4, 6 and 10 of the Chhattisgarh Agricultural Cattle Preservation Act, 2004 is made out against the applicant. It is further submitted that the seizure memo prepared by the prosecution is false. Learned counsel further submits that the charge-sheet has already been <led before the competent Court and the applicant has no criminal antecedents and he is in judicial custody since 11.06.2026. Therefore, no further custodial interrogation of the applicant is required and the trial is likely to take some time for its conclusion. Hence, the applicant may be enlarged on bail. 4. On the other hand, learned State counsel, appearing for the State/non-applicant, opposes the bail application and submits that the charge-sheet has already been <led before the competent Court. It is further submitted that there are serious allegations
3 against the applicant and the co-accused persons of transporting 19 cattle in a Mazda vehicle in an inhumane manner by stu6ng them inside the vehicle without proper arrangement of food and water. It is also submitted that no valid documents regarding the transportation of the cattle were produced by the applicant and the co-accused persons. Therefore, the applicant is not entitled to be released on bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case, nature and gravity of o=ence levelled against the applicant, period of detention of the applicant since 11.06.2026 and the fact that in the present case, charge-sheet has been <led before the competent Court and the applicant has no criminal antecedents and no further interrogation is required and the trial is likely to take some time for its conclusion, therefore, without further commenting anything on merits, I am inclined to grant bail to the applicant. 7. Accordingly, the bail application of the applicant is allowed. 8.
Let the applicant –Ashok Kumar, involved in Crime No. 248/2026 registered at Police Station- Aarang, District- Raipur (C.G.), for the o=ence punishable under Sections 4, 6 and 10 of the Chhattisgarh Agricultural Cattle Preservation Act, 2004, be released on bail on his furnishing a personal bond with two local sureties in the like sum to the satisfaction of the Court concerned with the following conditions:-
4 (i) The applicant shall <le an undertaking to the e=ect that he shall not seek any adjournment on the dates <xed for evidence when the witnesses are present in court. In case of default of this condition, it shall be open for the trial court to treat it as abuse of liberty of bail and pass orders in accordance with law. (ii) The applicant shall remain present before the trial court on each date <xed, either personally or through his counsel. In case of his absence, without su6cient cause, the trial court may proceed against him under Section 269 of Bharatiya Nyaya Sanhita. (iii) In case, the applicant misuses the liberty of bail during trial and in order to secure his presence, proclamation under Section 84 of BNSS. is issued and the applicant fails to appear before the court on the date <xed in such proclamation, then, the trial court shall initiate proceedings against him, in accordance with law, under Section 209 of the Bharatiya Nyaya Sanhita. (iv) The applicant shall remain present, in person, before the trial court on the dates <xed for (i) opening of the case, (ii) framing of charge and (iii) recording of statement under Section 351 of BNSS. If in the opinion of the trial court absence of the applicant is deliberate or without su6cient cause, then it shall be open for the trial court to treat such default as abuse of liberty of bail and proceed against him in accordance with law. 9. O6ce is directed to send a certi<ed copy of this order to the trial Court for necessary information and compliance forthwith. Sd/-
