Falguni Dey Mr. Debashis Banerjee Mr. Subrata Saha Mr. Abhik Biswas Mr. Rakesh Jana … for the petitioner. Mr. Sarwar Jahan Mr. Aninda Bhattacharya Mr. K.P. Santra … for the contemnor. 1. Mrs. Falguni Dey, the Pradhan of Chandra Gram Panchayat is personally present in response to the Contempt Rule issued. 2. Learned advocate representing the contemnor places the order dated February 27, 2024 alleged to be violated by the contemnor. 3. It appears therefrom that the writ petition stood disposed of by granting opportunity to the petitioner to file comprehensive representation before the Gram Panchayat highlighting his grievances. 4. On a perusal of the representation dated May 14, 2024 filed by the petitioner, it appears that details of the unauthorized construction are not disclosed in the said representation. 5. The petitioner, thereafter, by a legal notice has requested the contemnor to comply the direction passed by the Court. The said legal notice also does 2 not disclose the nature of unauthorized construction complained of by the petitioner. 6. After issuance of the Contempt Rule, a notice of hearing has been issued by the contemnor. The hearing, however, is yet to be held. 7. As it appears that a formal representation disclosing the nature of unauthorized construction is not on record, accordingly, no order can be passed in the contempt application. 8. The contempt application stands disposed of with the observation that it will be open for the petitioner to file a proper representation disclosing the nature and details of the unauthorized construction complained of. 9. On receipt of such representation, the contemnor shall take steps to consider the same in accordance with law at the earliest after giving reasonable opportunity of hearing to all the necessary parties. A reasoned order shall be passed and communicated to the parties. 10. Contempt Rule stands discharged. 11. Personal appearance of the contemnor is dispensed with. 12. Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court. 3 13. Certified server copy of this order, if applied for, shall be made available to the parties. (Amrita Sinha, J.)
