JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question proceedings in C.C.No.21681/2023, pending before XLVIII Addl. CJM, Bengaluru Rural District at Bengaluru, for the offences under Sections 506, 504, 354 of Indian Penal Code. 2. Heard Sri. Khadarbasha Husensab, learned counsel appearing for the petitioner, Sri. K.Nageshwarappa, learned HCGP appearing for respondent No.1, Sri.K.N.Udayashankar, learned counsel appearing for respondent No.2 and have perused the material on record. - 3 - HC-KAR CNR: KAHC010279752026 NC: 2026:KHC:39039 CRL.P No. 6033 of 2026 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with the joint affidavit. The joint affidavit reads as follows: “JOINT AFFIDAVIT 1. I, Syed Ibbad are the accused / petitioner in the above case and I am fully conversant with the facts of the case and I am swearing to this affidavit. 2. I Gowhar Unnissa I am the complainant in the above case and I am fully conversant with the facts of the case and I am swearing to this affidavit. 3. We all submit that, we have filed an application u/s 320(2) of Cr.Pc to compound the offences in the above criminal petition. 4. That, the Respondent no 2 have no disputes with the present Petitioner. 5. That. I Respondent no 2 have no issues with the present Petitioner and I have no objections in quashing the entire proceeding in C.C. No. 21681/2026 and we both the parties willing to report the settlement and seeking the quashing of the entire proceeding as settled. 6. That, the complainant and Petitioner have no other claims against each other. 7. That the we both parties have settled our disputes and matter has been compromised between us in the presence of the well-wisher. 8. That, this Hon'ble court have jurisdiction u/s 482 of CRPC to quash the entire proceeding basis settlement between the parties. 10. We submit that, we have settled our disputes with own will and wish without any influence or force. What is stated above is true and correct to the best of my knowledge, information and belief. UR WHEREFORE, it is most respectfully prayed that this Hon'ble may please to: A. Allow application filed u/s 320 of CRPC and permit the parties compound the offences. B. Pleased to entire quash the entire proceedings in C.C No. 21681/2023 (in Crime No. 231/2022) for alleged offences punishable under sections 506, 504 and 354 of IPC registered and charged sheeted by the respondent police i.e. Wilson Garden Police station pending on the file of Hon'ble XLVIII Addl. Chief Judicial Magistrate, Bengaluru in the interest of justice and equity.” 4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed. [II] Proceedings in C.C.No.21681/2023, pending before XLVIII Addl.
