THE HON’BLE SRI JUSTICE NYAPATHY VIJAY W.P.No.16346 of 2026 O R D E R: The present Writ Petition is filed questioning the action of the respondents in not considering the case of the Petitioner for promotion to the post of Deputy Superintendent of Police, without reference to the Departmental Proceedings initiated against the Petitioner vide C.No.08/C2/PR/RO/2022, dated 08.07.2022 as illegal and arbitrary. 2. The Petitioner is working as an Inspector of Police. A Departmental Enquiry was initiated against the Petitioner with regard to a dereliction of duties and a failure to file the Dying Declarations of D.1 and D.2 in Cr.No.48 of 2015 under Section 302 IPC of the Dharmavaram Urban Police Station with the charge sheet, which were received from the Tahsildar, Dharmavaram. 3. The Petitioner thereafter submitted his explanation, and after due enquiry, the Inquiry Report was submitted on 11.07.2023, holding that the Charge framed against the Petitioner is not proved. Though a dissent notice was given by the Disciplinary Authority on 30.10.2023, no further action has been taken thereon by the Respondents till date. Parallelly, the Criminal case vide S.C.No.106 of 2016 pending on the file of the Family Court-cum-Additional Sessions Judge, Ananthapuram for the offence punishable under Section 302 IPC, to which the impugned Article of Charge pertains, ended in a conviction imposing life imprisonment on the Accused therein. 4. Sri Posani Venkateswarlu, learned Senior Counsel appearing for the Petitioner submits that under the present factual scenario, the case of the Petitioner should be considered for the post of Deputy

Superintendent of Police without reference to the Departmental Proceedings vide C.No.08/C2/PR/RO/2022, dated 08.07.2022. 5. Learned Assistant Government Pleader on instructions submits that the case of the Petitioner would be examined in terms of G.O.Ms.No.257 General Administration Department, dated 10.06.1999 and appropriate orders would be passed expedituously. 6. Heard the learned counsels. 7.
As narrated above, the Article of Charge framed against the Petitioner pertained to the conviction case in S.C.No.106 of 2016 pending on the file of the Family Court-cum-Additional Sessions Judge, Ananthapuram for the offence punishable under Section 302 IPC, and the said Court after a full-fledged trial had imposed life imprisonment on the accused therein, which belies the charge against the Petitioner. Though a dissent notice was issued by the Disciplinary Authority on 30.10.2023, apparently, no reason is forthcoming from the Respondent Authorities as to the delay in concluding the Disciplinary Proceedings initiated against the Petitioner. 7. In the above circumstances, taking note of the Inquiry Report and the conviction imposed by the Session Court in S.C.No.106 of 2016, the present Writ Petition is disposed of with the following directions: i) The Respondents are directed to consider the case of the Petitioner for promotion to the post of Deputy Superintendent of Police without reference to the impugned Departmental Proceedings vide C.No.08/C2/PR/RO/2022, dated 08.07.2022. ii) There shall be no order as to costs. 4
