Suresh Kumar, learned counsel for the Petitioner, and the learned Assistant Public Prosecutor. 2. The short grievance of the learned Senior Counsel appearing for the Petitioner is that Crl.M.P.No.163 of 2025 in Crl.M.P.No.315 of 2025 in 2 Dr.YLR, J Crl.P.No.2635 of 2026 Dated 07.04.2026 Crl.M.P.No.998 of 2015 in C.C. No.10 of 2018 is pending on the file of the learned Principal District and Sessions Judge-cum-Special Court for A.P.P.D.F.E. Act, 1999, at Eluru, West Godavari District, for a considerable period. 3. The learned Assistant Public Prosecutor submits that the learned Trial Court, by docket order dated 28.11.2025 in Crl.M.P.No.315 of 2024, recorded that the petitioner therein failed to furnish the encashable bank guarantee and, consequently, dismissed the petition for default. 4. Be that as it may, when a petition is pending before the learned Trial Court, the Court is under an obligation to dispose of the same on its own merits. 5. Considering the facts and circumstances of the case, the learned Trial Court is directed to dispose of Crl.M.P.No.163 of 2025 on its own merits, in accordance with law, within a reasonable time. It is needless to observe that the parties to the petition are at liberty to raise their objections, if any, and the learned Trial Court shall consider the same on their own merits and pass a reasoned speaking order in accordance with law..
