The case of the petitioners is that they are members of respondent no.4-Society and there have been misappropriation of funds in respondent no.4-society. Hence, the petitioners have made necessary complaints to the Registrar of Co-operative Societies to initiate appropriate action in accordance with law. As the same has not been done, the present petition is filed with the following prayers: "i) Issue writ of mandamus to the respondent No.2 and 3 to take action complete enquiry under Section 64 of the KCS Act 1959 also on the basis of the representation dated 14.06.2023, 30.12.2024, 17.01.2025 and 06.05.2025 vide Annexure-A, Annexure-D, Annexure D-1 and Annexure D-2 respectively submitted by the petitioner. ii) Pass such order/s as this Hon'ble court deems fit under the circumstances of the case, in the interest of justice." 3. Learned AGA for respondent Nos.1 to 3 as well as learned counsel appearing for respondent no.4-Society submit that - 5 - HC-KAR CNR: KAHC010449802025 NC: 2026:KHC:42212 WP No. 20602 of 2025 pursuant to filing of the present petition, an enquiry has been instituted by respondent No.3 under the provisions of the Karnataka Co-operative Societies Act, 1959 ('the Act' for short) and an order has been passed under Section 68 of the Act. In light of the same, it is submitted that the writ petition has become infructuous and the same may be dismissed. 4. In the light of the submission made by the learned AGA for respondent Nos.1 to 3 as well as the learned counsel for respondent no.4, the writ petition is dismissed as having become infructuous.
