By presenting this writ petition, prayer is made for directing concerned police authorities to remove one permanent structure of brick and cement, which stands in front of premises no. 47 Dent Mission Road, Kolkata. 2. It is submitted on behalf of petitioners that there were two temporary structures which were utilized for selling flowers and chicken but same structures were removed by the concerned police authorities. 3. According to the petitioner, steps are required to be taken for removal of the third structure which is standing in front of the premises in question. 4. Learned advocate representing State respondents has filed a communication dated 23rd July, 2026 of Officer- in-Charge, Ekbalpore Police Station and same is taken on record. Copy of the said communication [2] dated 23rd July, 2026 is made over to learned advocate representing petitioner no.2. 5. It is disclosed in the said communication dated 23rd July, 2026 that police authorities have already removed temporary structures housing two shops but according to the concerned police authority, permanent structure which is standing in front of the premises in question needs to be removed by initiating appropriate proceeding. 6. Having considered the respective submissions made on behalf of parties, Court finds that primarily this writ petition is instituted, inter alia, praying for removal of a permanent structure which is standing in front of the premises in question as it appears from the communication dated 23rd July, 2026. 7. If petitioner finds that the said structure is unauthorizedly constructed, in that event, concerned authority of Kolkata Municipal Corporation (KMC) needs to be approached in accordance with law. 8. Granting liberty to petitioner to approach concerned authority of KMC, present writ petition is disposed of. 9.
