Mr. Shataroop Purkayastha. …for the State. Learned advocate appearing for the petitioner submits that the petitioner has been implicated on the alleged recovery of 25 bottles of codeine phosphate. Petitioner is in custody for more than 6 months, charge-sheet has already been submitted before the jurisdictional court, as such, petitioner may be released on bail. Learned advocate for the State opposes the prayer for bail. I have taken into account the period of detention and the charge-sheet reflecting number of witnesses to be examined by the State. Having considered the same, I am inclined to release the petitioner on bail as there are no antecedents of the present petitioner. As such, the prayer for bail of the petitioner is allowed. 2 Accordingly, the petitioner, namely, Md Idul Miya @ Mia shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, under NDPS Act, 4th Court, Malda. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Malda without prior permission of the learned special court. Thus, CRM(NDPS) 1274 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
