JUSTICE SACHIN SHANKAR MAGADUM ORAL ORDER The captioned writ petition is filed under Articles 226 and 227 of the Constitution of India seeking issuance of a writ in the nature of mandamus directing respondent No.2 – the jurisdictional Sub-Registrar to register the sale deed in favour of the petitioner in respect of the dry land bearing Sy. No.24, Block No.3 measuring an extent of 3 acres 35 guntas situated at Marasangala Village, Mallipatna Hobli, Arakalagudu Taluk, without insisting upon production of an 11-E sketch, in the light of the compromise decree dated 09.12.2023 passed in O.S. No.32/2023. - 3 - HC-KAR NC: 2026:KHC:19872 WP No. 11243 of 2026 2. The facts leading to the present petition, as borne out from the records, would indicate that the petitioner had instituted a suit for specific performance in O.S.No.32/2023 seeking enforcement of an agreement of sale. It is the specific case of the petitioner that during the pendency of the said suit, the parties have amicably settled their dispute and a compromise petition came to be filed under Order XXIII Rule 3 of CPC. The competent Civil Court, upon being satisfied with the terms of compromise, has recorded the same and consequently a compromise decree came to be drawn on 09.12.2023. Placing reliance on the said compromise decree, the petitioner claims to have approached respondent No.2– Sub-Registrar for registration of the sale deed in respect of the schedule property. 3. However, on scrutiny of the material placed on record, it is evident that the petitioner seeks registration of a portion of land measuring 3 acres 35 guntas carved out of a larger extent of 4 acres held by his vendor in Sy. - 4 - HC-KAR NC: 2026:KHC:19872 WP No. 11243 of 2026 No.24, Block No.3. It is also not in dispute that the total extent of land comprised in the said survey number is approximately 56 acres. In such circumstances, when the petitioner is seeking registration of a specific portion out of a larger survey number, the requirement of furnishing an 11-E sketch assumes significance for proper identification and demarcation of the property sought to be conveyed. 4. Having regard to the aforesaid factual matrix, this Court is of the considered view that mere existence of a compromise decree in favour of the petitioner would not dispense with the statutory requirement of producing an 11-E sketch, which is necessary to identify the exact portion of land proposed to be registered. In the absence of such a sketch, the Sub-Registrar would be justified in insisting upon compliance of the said requirement, and therefore, no mandamus can be issued to respondent No.2 to register the sale deed without the same. - 5 - HC-KAR NC: 2026:KHC:19872 WP No. 11243 of 2026 5. However, this Court deems it appropriate to reserve liberty to the petitioner to make an appropriate application for issuance of an 11-E sketch through the prescribed online mode before the competent authority. If such an application is submitted, the concerned authorities shall consider the same expeditiously and pass appropriate orders in accordance with law, within a reasonable time frame.
