The subject matter of the present case relates to alleged recovery of 8765 bottles of Phensedyl and the petitioner is in custody for 1 year and 7 months. There is already a direction in respect of another accused person which was referred to by the NCB and was passed in connection with CRM (NDPS) 1134 of
2026. There has been a subsequent event and the stage of consideration of charges are over. Dates have been fixed on 07.08.2026 and 10.08.2026 for examination of the seizing officer.
Having considered the stage of the case, I direct the learned Trial Court to complete the evidence of the seizing officers within a period of 3 months. If, after the evidence of the
2 seizing officers, the learned Trial Court is of the opinion that there is dilution in the prosecution, learned Trial Court would not hesitate to release the petitioner on bail.
However, at this stage, the prayer for bail of the petitioner in CRM (NDPS) 1493 of 2026 is dismissed.
Report submitted by the NCB be kept with the record.
