JUSTICE S VISHWAJITH SHETTY ORAL ORDER 1. Accused in S.C.No.225 of 2023 pending before the Court of II Addl. District & Sessions Judge, Hassan, arising out of Crime No.81 of 2023 registered by Holenarasipura Rural Police Station, Hassan District, for offences punishable under Section 302 of IPC is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. FIR in Crime No.81 of 2023 was registered by Holenarasipura Rural Police Station, Hassan District for the aforesaid offence, based on the first information dated 20.07.2023 received from Sri Vinay Kumar C, Police Officer attached to Holenarasipura Rural Police Station. In the said case, petitioner was arrested on 20.07.2023 and remanded to judicial custody. In the charge sheet which was filed subsequently petitioner is arraigned as sole accused. His bail application filed before the Trial Court in S.C.No.225 of 2023 was rejected on 22.08.2025. The deceased Ambika was the wife of the petitioner and the allegation against the petitioner is that he was ill- treating her for money and also physically assaulting her. In the alleged incident that had taken place on 20.07.2023, the petitioner, who had quarrelled with his wife, had assaulted her with his hand and when she fell down, he allegedly dropped a stone on her head and committed her murder. It is brought to the notice of this Court that all the material charge sheet witnesses have been already examined in the present case and even the recording of Section 313 Cr.P.C, statement of the accused is completed. The matter is now at the stage of addressing final arguments. 4. Considering the aforesaid aspects of the matter, I am of the view that, if this petition is disposed of with a request to the Trial Court to dispose of the main case on merits within a time frame, the same would serve the ends of justice.
