1. The petitioner is aggrieved that she has not been granted compassionate appointment, upon the death of her husband, who was a Constable with the Border Security Force. The husband of the petitioner died in- harness, whereupon the petitioner applied for compassionate appointment.
2. The application of the petitioner has been rejected on the ground that she has crossed threshold age limit and cannot be appointed.
3. Pursuant to the request made by this Court, Mr. Bajpayee, learned Advocate appearing for the Union of India, has obtained necessary instructions. A copy of such report is taken on record.
4. It appears from the tenor of the instruction that not just the issue of age but also the question of availability of a commensurate post for appointment of the petitioner has been considered. There is no available vacancy in any post to which the petitioner

can be appointed.
5. The authorities are directed to consider the writ petition as a representation of the petitioner and dispose of the same within a reasonable time preferably within a period of six months from the date of communication of this order in accordance with law and in line with the prevalent provisions guiding the issue of compassionate appointment in the Force.
6. With the afore-stated directions, the writ petition is
disposed of.
7. There shall, however, be no order as to costs.
8. Parties to act on the basis of the server copy of this
order duly downloaded from the official website of this Court.
