CORAM:- HON'BLE MR. JUSTICE DEEPAK GUPTA Present:- Mr. Amit Jaiswal, Advocate for the peoner. Mr. H.S. Dhindsa, Advocate for LRs of the respondent. **** DEEPAK GUPTA, J. (ORAL) The present revision peon has been preferred by the tenant under Secon 15(5) of the East Punjab Urban Rent Restricon Act, 1949, assailing the
order dated 28.07.2025 passed by the learned Rent Controller, Mohali whereby the evicon peon instuted by the respondent-landlord under Secon 13 of the East Punjab Urban Rent Restricon Act, 1949 was allowed on the ground of the landlord's bona fide personal requirement. The appeal preferred by the peoner against the said order also came to be dismissed by the learned Appellate Authority Mohali vide judgment dated 19.02.2026, thereby affirming the findings recorded by the Rent Controller.
2. Aggrieved against the aforesaid concurrent findings, the peoner- tenant has invoked the revisional jurisdicon of this Court.
3. In compliance with the earlier direcons issued by this Court, both the pares have placed on record their respecve affidavits regarding the present status of the demised premises. While the peoner asserts that he connues to remain in possession thereof, the respondent-landlord claims that the premises NEETIKA TUTEJA 2026.07.23 10:58 I attest to the accuracy and integrity of this document
CR-4566-2026 (O&M) have already been vacated.
4. Since the present revision peon is being finally disposed of on merits, this Court does not consider it necessary to adjudicate upon the aforesaid disputed queson of fact regarding the present possession of the demised premises, parcularly when the same does not have any bearing on the ulmate disposal of the present proceedings.
5.
Learned counsel for the peoner was heard at considerable length. However, during the course of hearing, when this Court expressed its prima facie view that no case for interference with the concurrent findings of fact recorded by the Courts below was made out in exercise of the limited revisional jurisdicon vested in this Court, learned counsel, on instrucons, confined his prayer to seeking reasonable me to vacate the demised premises. 6. The request for grant of reasonable me has not been seriously opposed by learned counsel appearing for the respondent-landlord. 7. On instrucons received from their respecve clients, learned counsel for both the pares have fairly stated that they have arrived at a consensus that the peoner may be permi@ed to retain possession of the demised premises up to 31.01.2027, subject to appropriate condions safeguarding the interest of the landlord. 8. Having considered the submissions advanced and keeping in view the consensual stand adopted by the pares, this Court is of the opinion that the ends of jusce would be adequately served by granng the peoner reasonable me to vacate the premises on the agreed terms. Since the arrangement is founded upon the consent of the pares, the same deserves to be accepted and incorporated in the order. 9. Consequently, without expressing any final opinion on the merits of Page No. 2 of 3 Pages NEETIKA TUTEJA 2026.07.23 10:58 I attest to the accuracy and integrity of this document
