ORAL ORDER
1. Accused No.1 in Crime No.180/2026 registered by Tumakuru Town Police Station, Tumakuru, for the offence punishable under Section 20(b)(ii)(B) of the NDPS Act, 1985, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.180/2026 was registered by Tumakuru Town Police Station, Tumakuru, for the aforesaid offence against the petitioner and another based on the first information dated 11.06.2026 received from Shantharaju, police officer attached to Tumakuru Town Police Station. In the said case, petitioner was arrested on 11.06.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.900/2026 was rejected on 20.06.2026. Therefore, he is before this Court. 4. In the first information dated 11.06.2026 submitted by the police officer attached to Tumakuru Town Police Station, he has stated that on the said date, he had received credible

information at about 11.30 a.m. that a person was allegedly making attempt to sell contraband article allegedly ganja weighing about 1 kg and when an attempt was made to apprehend the said person, he allegedly tried to escape. After he was apprehended, it was found that he was in possession of contraband article allegedly ganja totally weighing 1 kg 145 grams. The said contraband article and the mobile phone of the said person, who is arraigned as accused No.1 in the present case were recovered under a panchanama and thereafter, arrested accused was produced before the Court and remanded to judicial custody. Petitioner aged 19 years has no other criminal antecedents. Seized contraband article is a little more than 1 kg. The contraband article ganja, upto 1 kg is considered as small quantity. The seized contraband article in the present case is of intermediate quantity and therefore, the rigour under Section 37(1)(b) of the NDPS Act, cannot be made applicable. Petitioner is a youngster and has no other criminal antecedents. Under the circumstances, the following order:-

The petitioner is directed to be enlarged on bail in Crime No.180/2026 registered by Tumakuru

Town Police Station, Tumakuru, for the offence punishable under Section 20(b)(ii)(B) of the NDPS Act, 1985, subject to the following conditions:
a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed off.
