Mr. Nilotpal Chatterjee Mr. Amrita Lal Chatterjee …..for the State. 1. In our view, the appeal has become infructuous. Accordingly, the appellant wants to withdraw the same. 2. Such prayer is allowed. 3. Mr. Chatterjee, learned advocate for the respondents submits that, on the date of the meeting the requisitionists were physically restrained by the police authorities from casting their vote. As such, the motion was not carried. They filed a complaint before the prescribed authority which was forwarded to the District Magistrate. 4. Thus, he wants us to take judicial notice of such fact. The prescribed authority has already received the complaint and forwarded the same to the 2 District Magistrate. The complaint will be dealt with by the Prescribed Authority, will take its own course and consequences will follow. We are not in a position to pass any further orders on the application filed by the requisitionists. However, the allegations made by Mr. Chatterjee gives rise to a fresh cause of action. The requisitionists who were allegedly restrained by the police authorities from casting their vote may take appropriate steps. 5. Accordingly, the appeal and the connected applications are dismissed as withdrawn. 6. Parties are directed to act on the basis of the server copy of this order. (Shampa Sarkar, J.)
