Mr. Sandip Chakraborty Mr. Arup Kumar Bhowmick …for the petitioner. Mr. Sagar Saha Ms. Nayana Mukhopadhyay …for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than nine and half months. Learned advocate for the petitioners emphasizes on the subject matter of challenge relating to default bail as has been passed in the case of State of West Bengal versus Idul Mia in SLP (Crl.) NO. 16698 of 2024. Reference has been made to the order passed in Bachan Mandal versus State of West Bengal wherein the Hon’ble High Court was pleased to refuse bail, the said application has been challenged and is pending before the Hon’ble Supreme Court. Learned advocate appearing for the State has submitted a report enclosing the chemical examiner’s report. I have taken into account the same chemical examiner’s report reflects presence of Diacetylmorphine (heroine) and 6Monoacetylmorphine. The chemical 2 examiner’s report is of no assistance to the present petitioners. Accordingly, I am not inclined to release the petitioner on bail. The petitioners will approach this court after the evidence of the seizure list witnesses is over. At this stage, CRM (NDPS) 1456 of 2026 is dismissed. Report filed by the State is taken on record.
