Kausik (Allowed) CRM (NDPS) 1709 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Karimpur Police Station Case No. 285 of 2022 dated 07.11.2022 under Sections 21(c)/29 read with Section 8(C) of the NDPS Act, 1985. And In the matter of : Monirul Sk @ Seikh ……Petitioner. Mr. Soumyajit Das Mahapatra Mr. Abdul Aziz Mondal ……for the Petitioner. Mr. Krishnendu Bhattacharya Mr. Shourjyo Mukherjee ……for the State. Learned advocate appearing for the petitioner submits that petitioner was arrested on 07.11.2022 and is in custody for 3 years 9 months. Earlier there were repeated directions of this Court but the same did not yield any result. Lastly, after the examination of the accused persons under Section 313 of the Cr.P.C. was done in November, 2025 and argument was heard in-part, an application under Section 311 of the Cr.P.C. for recalling the PW 4 was submitted. It was directed to complete whole of the process within a scheduled time and as such the earlier bail application of a co-accused in CRM(NDPS) 770 of 2026 was rejected. 2 On 08.05.2026 the application under Section 311 Cr.P.C. of the prosecution was allowed. PW 4 was directed to be recalled. However, on 29.06.2025 PW 4 was not present. Next date has been fixed on 29.08.2026. Learned advocate for the State submits that another opportunity be granted to the State. I have taken into account the manner in which the criminal case is progressing. No time schedule has been adhered to. Petitioner is in custody for more than 3 years 9 months. As such, I am of the view that let the prosecution and the Trial Court take its own time. Petitioner be released on bail. Accordingly, Petitioner, namely, Monirul Sk @ Seikh shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, under NDPS Act, Nadia, Krishnanagar. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Nadia without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 1709 of 2026 is allowed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. 3 Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
