Mr. Ghosh, learned advocate appearing for the petitioner, referring to the order dated 12th September, 2024 passed in WPA(P) No. 390 of 2024, submits that in the earlier round of litigation, the aforesaid writ petition was disposed of by directing the Executive Engineer, Public Works (Roads) Directorate, Tamluk Highway Division, to consider the representation submitted by the petitioner. In compliance with the said order, a hearing was conducted on 10th June, 2025. Thereafter, the Assistant Engineer concerned was directed to restore possession of the Government land belonging to the PWD, in terms of the demarcation report, by removing the unauthorized encroachers and/or occupiers.
Records reveal that, pursuant to the aforesaid direction, the Sub-Divisional Officer has issued a show cause notice inviting encroacher’s explanation as to why proceedings under Section 10(3) of the West Bengal Highways Act, 1964 Act should not be drawn up against him. In view thereof, no further interference is called for in the present writ petition. Accordingly, the present writ petition being WPA(P) 317 of 2026 is disposed of.
