The Court made the following Judgment: (Per Hon’ble Justice Ninala Jayasurya) With the consent of counsel on both sides, the matter is disposed of by way of the following order:
2. W.A.No.481 of 2026 is preferred against the order of learned Single Judge dated 18.03.2026 in W.P.No.7583 of 2026.

In the said writ petition, order dated 04.12.2025 of Revenue Divisional Officer-cum-Sub-Divisional Magistrate in O.P.No.1273 of 2025 filed under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 was under challenge. Writ petitioner therein is the daughter of the appellant. Vide said order dated 04.12.2025, she was directed to pay an amount of Rs.25,000/- per month to her mother towards maintenance. Learned Writ Court modified order dated 04.12.2025 and awarded an amount of Rs.20,000/- as monthly maintenance, apart from other medical and miscellaneous expenses.
4. We have heard Mr.N.Subba Rao, learned Senior Counsel appearing for the appellant / respondent No.5. Also heard learned counsel for the writ petitioner. Perused the material on record.
5. Main contention of appellant is that Writ Court disposed of the writ petition without ordering notice, much less by affording an opportunity to file counter. Further that had an opportunity been afforded, relevant facts would have been placed for appreciation by learned Writ Court and at any rate, order under appeal reducing amount towards maintenance awarded by the Authority

under the Act, without hearing appellant is in gross violation of principles of natural justice. Impugned order is, therefore, liable to be set aside.
6. It is also submitted that appellant filed a separate Writ Petition No.10871 of 2026 against order dated 04.12.2025 passed by Competent Authority and the Writ Appeal may be allowed by setting aside the impugned
order for the aforesaid reasons and a direction be issued to hear writ petition afresh along with W.P.No.10871 of 2026.
7. Admittedly, the impugned order has been passed without affording opportunity to appellant / 5th respondent. Writ Court committed an error in not deciding the matter after ordering notice to appellant / 5th respondent in whose favour, Authority under the Act granted maintenance. The order under appeal is therefore unsustainable.
8. At this stage, learned counsel for 1st respondent / writ petitioner agreed for disposal of Writ Appeal without going into merits and consideration of issues afresh by learned Writ Court, by setting aside order under appeal.
9. In the aforementioned circumstances, order under challenge dated 04.12.2025 is set aside. Writ Petition No.7583 of 2026 shall be restored to file and listed on 30.06.2026 before Writ Court having the Roster for consideration along with W.P.No.10871 of 2026.

10. Accordingly, impugned order is set aside and appeal stands disposed of. No costs.
Consequently, pending Miscellaneous Applications in the Writ Appeal, if any, are dismissed accordingly.
