Versus The State of West Bengal Mr. Kunal Ganguly. …for the petitioners. Mr. Madan Mohan Roy Mr. Ansuman Bera. …for the State. Mrs. Manasi Roy. …for the de facto complainant. Learned advocate appearing for the petitioners submits that the petitioners are the female members who have been foisted with the criminal case. There are civil suit pending between the parties which is a genesis of the present dispute. Learned advocate for the de facto complainant opposes the prayer for anticipatory bail State has produced the case diary. Drawn the attention of the Court to the statement of the injured as well as the injury report. So far as the statement of Samima Begum is concerned, 2 the same is vague and insist on participation of all the accused persons while that of Rokeya Khatun refers to Saifuddin. Saifuddin is not before this Court. All the members who are before this Court are ladies. However, having considered the injuries and the fact that two of the injured have to be administered stitches, I am not inclined to extend the benefit of anticipatory bail. However, if the petitioners being ladies surrender before the jurisdictional court, the jurisdictional court will consider their prayer for bail independently without being influenced by any observations made by this Court. With the aforesaid observations, CRM(A)2612 of 2026 is dismissed. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
