In Re: An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 corresponding to under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Chandipur Police Station Case No.134 of 2023 dated 20.04.2023 under Sections 363/365/364A/344/120B/506 of the Indian Penal Code;
Sk. Matibul Rahaman @ Sk. Mati Versus The State of West Bengal
Mr. Milon Mukherjee Mr. Supriyo Shasmal. …for the petitioner.
Mr. Sankalpa Bhattacharjee. …for the State.
Learned senior advocate appearing for the petitioner submits that the petitioner has been falsely implicated in the instant case and intends to appear before the jurisdictional court.
Learned advocate for the State opposes the prayer for anticipatory bail.
The case is of the year 2023. Accordingly, if the petitioner appears before the jurisdictional court and prays for regular bail, learned court would independently consider the bail application without being influenced by any observations made by this Court.
Thus, CRM(A)1861 of 2026 is dismissed.
